The Role and Strength of the Arguments Deriving from the Existing Law in the Enlightenment Parliamentary Discourse (Based on the Parliamentary Speeches by Kazimierz Nestor Sapieha)

The article discusses: the meaning, form, function and effectiveness of legal argumentation in Enlightenment parliamentary discourse on basis selected speeches by Kazimierz Nestor Sapieha, an experienced MP Marshal Lithuanian Confederation Four-Year Sejm. On rhetorical analysis oration, it was proved that use is one typical strategies, but its varied depending communicative circumstances, subject session, speaker’s skills expectations audience. Partial inefficiency this type compensated elaborate form: subtle easy to read audience allusion, a quotation from Sejm’s constitutions their periphrasis, sententia presenting essence meaning law social, political moral life. study proves technique prevails Sapieha’s advisory speeches, who skill fully combines with other types reasoning, for instance: arguments based parallels, tradition definition, eristic techniques: authority, communicatio, subiectio, ad personam, populum, thanks which persuasive manipulative strength increased.
